Every matter begins with a document review. No external step is taken — no letter to an insurer, no filing — until the evidence is assembled and assessed.

Court-Aligned Valuation

Quantum is assessed against current Malaysian judicial decisions before any position is taken. This prevents both under-settlement and unrealistic expectations.

Client-Directed Decisions

At each juncture — whether to accept an offer, counter, or proceed to trial — the decision rests with you, informed by written advice and a clear explanation of the options.

Initial Assessment & Claim Preparation

A careful first engagement for individuals or families considering a personal injury claim. We move at a pace that the client sets. Where we are unable to assist, there is no charge for the conversation and assessment.

What Is Included

  • Private consultation at a client-directed pace
  • Collection and collation of police reports, medical records, and repair invoices
  • Advice on time limitation under the Limitation Act and relevant sectoral statutes
  • Written note setting out likely heads of claim
  • No charge if the firm determines it is unable to assist

Negotiated Settlement with Insurers & Institutions

RM 2,950

A focused mandate for claims that can be resolved without contested proceedings. We enter negotiations only when the evidence pack is complete and the quantum position is documented. No pressure is placed on early offers that fall short.

What Is Included

  • Instructing medical reporting doctors where needed
  • Quantum note in line with current Malaysian court trends
  • Handling all offer exchange correspondence
  • Release documentation with client's informed consent
  • Written updates at each stage of the negotiation

Typical Timeline

Once the evidence pack is complete and the quantum note prepared, negotiation typically runs two to six months depending on the insurer's responsiveness and the complexity of medical evidence. We do not rush this process.

Service Three

Contested Proceedings in Sessions & High Court

RM 5,450

Full representation where settlement is not achievable on reasonable terms. A lead counsel accompanies the matter from the date of filing through to final account — including enforcement where a judgment is obtained and, where the claimant is a minor, supervision of court-ordered disbursement.

  • Filing, pleadings, and interlocutory applications
  • Coordination with treating doctors for expert evidence
  • Witness preparation through measured practice sessions
  • Trial advocacy before Sessions or High Court
  • Post-judgment enforcement support
  • Court-supervised disbursement for minor claimants

Typical Timeline

Contested proceedings in Malaysia typically run one to three years, depending on court scheduling, complexity of medical evidence, number of witnesses, and any interlocutory matters. We provide written updates at every stage.

No oral advice is treated as binding. Every substantive position is provided in writing, in plain language, before any action is taken.

Fee Transparency

Fees are agreed in writing at engagement. Disbursements are itemised and approved by the client before they are incurred.

Bar Compliance

All practitioners hold current Malaysian Bar Annual Practising Certificates and comply with the Legal Profession (Practice and Etiquette) Rules 1978.

Proper Release Documentation

Settlements are concluded through correctly executed discharge and release documents with the client's free and informed consent.
