Terms & Conditions

Last Updated: 10 March 2025  |  Effective: 10 March 2025

1. Definitions

In these Terms and Conditions:

2. Acceptance of Terms

By accessing this Website or engaging the Firm's services, you agree to be bound by these Terms and Conditions. Use of this Website is permitted only for lawful purposes and in a manner that does not infringe the rights of others. You must be at least 18 years of age, or acting as a parent or guardian with capacity to enter into a legal agreement on behalf of a minor.

3. Service Description and Availability

The Firm provides personal injury legal services in Malaysia, including initial claim assessment, insurer negotiation, and court representation. Services are subject to availability and to the Firm's assessment of whether a matter is suitable for engagement. The Firm reserves the right to decline any instruction.

The information on this Website is provided for general guidance only and does not constitute legal advice. No solicitor-client relationship is established by use of the Website alone.

4. Engagement Process

A formal legal engagement begins only upon signature of an Engagement Letter. Prior correspondence — including any initial assessment note or email — does not create a binding retainer. The Firm will not commence work on your matter until an Engagement Letter has been signed by both parties and any required payment has been received.

5. Client Responsibilities

You agree to:

Failure to provide timely instructions or accurate information may adversely affect your matter and may entitle the Firm to terminate the engagement.

6. Intellectual Property

All content on this Website — including text, design, and structure — is the intellectual property of Pulih Law and may not be reproduced without written permission. Nothing on this Website grants any licence to use the Firm's name, logo, or content.

7. Payment Terms

Service fees are as stated in the Engagement Letter. Fees are payable in Malaysian Ringgit (MYR). Disbursements — including medical report fees, court filing fees, and expert witness costs — are itemised separately and are payable as they arise. The Firm will notify you before incurring material disbursements.

The initial assessment conversation carries no charge in cases where the Firm determines it is unable to assist. Where the Firm is able to assist, the assessment fee (RM 1,650) is payable on engagement.

If a matter settles during negotiation or court proceedings, fees applicable to that stage apply. Fees are not refundable in respect of work already completed.

8. No Outcome Assurance

Legal proceedings involve inherent uncertainty. Nothing in these Terms, on this Website, or in any communication from the Firm constitutes a representation that any particular outcome will be achieved. We do not provide assurances as to the value of any settlement or judgment.

9. Confidentiality

All information shared with the Firm in connection with a legal matter is protected by legal professional privilege and by our duty of confidentiality. We will not disclose your information to third parties without your consent, except as required by law, court order, or to the extent necessary to handle your matter (such as disclosure to a medical expert or insurer during proceedings).

10. Limitation of Liability

The Firm's liability to any client is limited to the fees paid by that client for the relevant service. We are not liable for indirect, consequential, or incidental losses arising from our engagement or from the outcome of a legal matter. Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by Malaysian law.

11. Termination

Either party may terminate the engagement by written notice. On termination, the Client is responsible for fees and disbursements incurred up to the date of termination. The Firm will return documents belonging to the Client and, where required by professional rules, assist with a transfer to new solicitors.

12. Dispute Resolution

Any dispute arising from these Terms or from a legal engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia. We encourage parties to attempt to resolve disputes informally before commencing formal proceedings.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia, including the Legal Profession Act 1976 and the Legal Profession (Practice and Etiquette) Rules 1978.

14. General Provisions

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Website following publication constitutes acceptance of the updated Terms.
